Nearly 2 dozen states join pork producers in SCOTUS Prop 12 appeal

“The Iowa Pork Producers Association, joined by 23 states, has appealed to the U.S. Supreme Court, challenging California’s Proposition 12, which regulates pig farming practices nationwide.

The appeal, filed Jan. 3, follows the Ninth Circuit Court’s dismissal of a lawsuit alleging Prop 12 discriminates against pork producers across the country. The states supporting the challenge include Iowa, Alabama, Arkansas, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Virginia, West Virginia and Wyoming.

While the Supreme Court previously upheld Prop 12 in 2023, five justices acknowledged it could impose a burden on interstate commerce under the Pike balancing test. Unlike the earlier case, the Iowa Pork Producers Association argues the law is discriminatory, asserting the Ninth Circuit erred in its ruling. The Supreme Court will now decide whether to take up the case.”
